Well, some of the early access users encountered the same issue, although I only purchased today so doesn't affect me. It is annoying, but given the sparsity of titles on the UK PSN at the moment, its not like I would have spent it on anything else.

As for EULA, I don't think digital goods have the same "fit for purpose" rights yet as covered by the sale of goods act. I know there was a bill being drafted but don't think its gone through yet, so as Duuude007 stated, we aren't entitled to anything. Just look at the cases attempted to be brought against EA for FIFA and Sim City, I don't think anyone successfully fought and won, even Watchdog on the BBC got the middle finger, EA didn't even respond.

Given that some MMO's have encountered launch issues in the past, I think it would normally come down to whether or not the company wants to ride the bad publicity or make amends for the issues.
