That would kinda suck; I like the fact that you can still do other activities while waiting for a duty finder party to fill up. If it put you in the dungeon, all you'd be able to do is sit there until the rest of the party showed up - which for DDs could be a long time. It would probably be hard on the servers as well, having who-knows how many instances just sitting idle with half-formed parties inside of them.

No, Delsus has the right idea. Don't tell a player whether a run is in-progress or not before they accept (not even sure why they DO tell the player this; it's hard to see any use for it that's not abuse), and apply some kind of incentive or penalty to prevent them from demanding a vote-kick if they don't like where they wound up.
