So it's a poor solution because you were already in the middle of something preventing you from accepting or were AFK? Both of which a few minutes are likely pretty irrelevant. I don't see how the honest player is being "punished".

Alternatively you don't understand the need for the queue timing out being included. You don't want to be waiting 45 seconds each attempt from that guy trying to get an in-progress.
