Cannot kick non randoms

So in a bit of a BS situation right now. Created a group on my server by advertising to build a group. Midway through the dungeon, one of the players lost connection and DCed and has not been back. Its now been 10 minutes, and because they are not a random, we cannot vote kick them, and hte leader cant just remove them mid dungeon.

So we are stuck in the middle of dungeon, cannot remove the person who isn't coming back at this point, so what are we to do? Take a penalty and leave the dungeon?

While I wish that they would allow us to replace members in a pre-made group, you should know that exiting while in a pre-made does not give you the time penalty.

I died in Haukke Manor. Got told to avoid the ice i have to smash my face into the keyboard, then got yelled to smash my face in the keyboard in all caps (Woah, we have a badass over here), i called him a loser then i got kicked.

I think you dont take any penality if you did pt of 8/8 members , can leave anytime

It's probably because pre-mades can be anything. You could be 8 WHMs running a dungeon. If you kick one person, and then try to replace them, what role does the DF pick to replace your lost member?

Well there is a join party in progress option, i guess none use that feature unfortunately.
How much are the penalties? We had to leave the Titan fight yesterday and sort of wondering
