yes, but only if you keep telling people you do it. theres no way to track it, and im pretty sure them tracking your IP to prove that you are tunneling is against online privacy laws.
You'd never have anyone official that says it's okay to use third party software because they would like to keep the option to ban you just in case they overlooked something. But unless you were sending them a screenshot of you using the software, chances are nobody's actually going to go through the effort to track you down for doing something that's essentially a fix for the game's netcode problem.
No, since the only thing the app does is open a proxy connection.
And a lot of people still need to set a proxy server to even connect to the internet. Banning people for using proxy servers would be like banning users for using X or Y ISP company.
If they started banning people for using a VPN (first they'd have to somehow detect it), they'd get a huge backlash from the online community.
Same reason they don't ban people who use macro keyboard/mice (unless they are deploying some unattended macro).
a VPN is no more 3rd party software then having teamspeak running to communicate in game. Or using some 3rd party overlay software to see who in teamspeak is talking in game, etc. Or using Xsplit to stream your game play.
Will they ban you if for some reason your local and small ISP used a VPN to route all their customers from country X to country Y? What if you're just playing at the office, and your office uses a point to point VPN to some central hub? No, they won't. Even if you tell them you're using a VPN they will not ban you.
Yes, their clause is very vague and technically they can ban you for any 3rd party software. Hell, they can ban you for having MS office running while playing FFXIV if they wanted to. They won't though, because that's just bad business.
a VPN is not cheating, or bypassing any game system, so you are fine.

Where and why would anyone get the idea that making use of a private network would/could be against the TOS? Private networks are ubiquitous throughout the internet. It would take quite the imagination to call using a VPN "3rd party software" usage... rather ludicrous to even mention that unless you want to include all kinds of innocuous things like software firewalls or internet connection sharing as "3rd party software". Not to mention, SE would have no real way or even reason to try and discern if some packets were coming/going across private networks at some point.

Only way you'd get banned is if the game is region locked, which I don't believe it is. If it is a vpn, if detected which it would be highly unlikely that it would be, would probably get you banned due to them assuming you are from a blocked region.
