This name applied the day people starting shouting for relic+1 to go to a level 50 story dungeon.
It's peoples' own fault for not reading the TOS. If you're caught buying gil you should be permabanned, end of story.
It's peoples' own fault for not reading up on laws. If you're caught handling counterfeit money you should be executed, end of story.
That's basically what you're saying after all. Somebody breaks the TOS once and you're all "MAXIMUM PUNISHMENT TO THE EXTREEEEEEEME!". Or ya know, they could suspend them, and warn them never to do it again.
Except that is no where near the same thing, yes killing someone is the same as a perma ban on a video game. It's peoples' own fault for not reading up on laws. If you're caught handling counterfeit money you should be executed, end of story.

Aside from the fact that it's exactly the same thing, yeah. Both cases involve dealing with illegal money, both cases are met with the absolute maximum punishment.
