ClickAndBuy have updated their general terms and conditions.

I recieved this email in my gmail junk filter. No doubt most people registered for clickandbuy will have also missed it as a consequence. It was sent on May 1st. For those concerned or curious, it reads:


Dear *your name here*,

We would like to inform you that we need to update our General Terms and Conditions for electronic money services (including our Privacy Policy). These new Terms will take effect for all account holders from 1st July 2011.

The changes have been made as a result of new laws for electronic money services in Europe (called the 2nd Electronic Money Directive). The resulting changes will bring additional improvements to the protection of the interests of users of electronic money and these are outlined for you in the new version of our E-Money Account Terms of Use, which can be found by visiting our website at http://clickandbuy.com/GB_en/terms-and-conditions.html

We have also used this as an opportunity to ensure different language versions of the Terms contain the same information, and thus provide what we think is the greatest possible transparency, clarity and legal certainty worldwide.

Please note, we’re not changing our prices, and ClickandBuy electronic money transactions used to pay for online purchases continue to remain free of charge. Please note that transactions involving foreign currencies will incur a Currency Exchange Fee.

You don’t need to do anything to accept the changes to these Terms as they will automatically come into force and become part of your existing contract with us. However, we’d like to point out that you can – of course – close your ClickandBuy account free of charge by contacting us if you decide you don’t want to continue using ClickandBuy under these new Terms.

I got mine around 2 weeks ago, but i couldn't bother myself with trying to find out what exactly they changed.

Not much i can do anyway...accept whatever it is and move on

They, along with many other online repositories of your personal information (SE included) got real scared following the PSN hack, and scrambled to remind people the importance of changing your passwords regularly, as well as trying to make sure they'd be okay should they be the next target on Anonymous' list.

With how Anonymous is treating customers world wide Anonymous should be the next one on Anonymous' list.

I'm not sure what has exactly changed either, but I'm noting the following things to watch out for regardless:

- The Law of England and Wales applies with the English court and it's precedents applicable.
- 13 Termination
13.3 By Us: We reserve the right to close Your Account and terminate the Contract at any time:
(a) by providing You with two months notice unless the provision of notice is legally prohibited or would compromise reasonable security measures and payment of any unrestricted funds held in custody, where:
(i) We are no longer providing the Service to users in the country in which You are resident or from which You use the Service; or
(ii) the provision of the Service to You by Us is no longer commercially viable
- 15. Governing Law and Legal Disputes
15.1 Complaints: In the event of any dispute or problem with the Service please always contact Our Customer Care team in the first instance. In the event that Your query is not satisfactorily resolved, You may lodge a complaint with Us by following the instructions on Our website, or write to Us at the address specified in section 3. Information regarding Our complaint handling procedures is also available upon request.
- From section 17, Funding our accounts by credit card (which we're doing) will incur a 3.9% surcharge!

I can't see any of the other dodgy clauses people have been talking about (good thing or am I missing something?). The majority of the documents seem to be with regards to the agreements between ClickAndBuy and the "Merchant", which is Squeenix.
