I was discussing this briefly and I was unaware that the NDA has been Changed from Open Beta to Phase 3. So if you plan to Record to show the whole world FFXIV ARR, the time to wait has been decreased!

I recall the PDF what showed up right after Nico Event did show the NDA was in place for phase 3. It could have been a copy and paste mistake during translation and corrected shortly after. There was some confusion on another thread where people thought the NDA was in place for phase 3.

Looks like it was changed Jan 10th-11th, its definitely changed from NDA in place to NDA lifted on phase 3, didn't know that either.
