Hit level 25, go to the respective GC you want your company to belong to, talk to the OIC administrator
You create a petition through him, once you get 3 other players to sign it and pay 15,000 gil you have your brand new FC

To rank up your FC you need to gain points through gathering/crafting rare materials or participating in FATEs

Actually, I started an FC with a mule character directly after finishing the tutorial quest in the Adventurer's guild and picking up the gil I'd sent myself via moogle mail. There doesn't seem to be any level or quest requirements. Just make sure you have the gil and can get the 3 sigs. The initial signatories don't even have to remain in the FC either if you just need them for numbers to start it. Great for private FC services for mules such as extra shared inventory space (the main reason I did it).

I believe this might only be the case with players that are returning from 1.0, no matter their level or rank, unless you just made the character fresh.

And frankly that sounds a lot like an abuse of the system that is intended to encourage companies rather than allow players to gain preferential services by cheating the system. I would hesitate before doing this sort of thing a lot.

It was a returning character but one that had no real progress in 1.xx.

I don't think it's abusing the system anymore than having mules does and there's no reason not to have mules too. Yes, both options get you extra space than your single character would normally have access to, but so what? We're allowed to have multiple characters, multiple accounts, multibox, etc. There's nothing even grey area about it, it's straight up supported by SE with instructions from SE on how to go about these things.
