Legacy Servers full?

So how exactly are they full?. To my advise only 1.0, and Legacy can go there?. I know it's a whole different engine, but I don't remember this happening in 1.0. Perhaps it was due to the instanced based world they brew?. Instead of making like the 1.0 world; without instances?. Sorry, but I'm just wondering. It's not like newcomers can get in.

Non-legacy players were able to create new characters on legacy servers. There aren't any special restrictions for character creation. However, characters from 1.0 could ONLY be transferred, during the allowed period prior to Beta Phase 4, to servers marked as Legacy.
