Vote Kick doesn't work if player errored out

Steps to Reproduce:
I was in Haukke Manor Hard (Duty Finder High lvl) - right after we died on the first boss the WHM errored, not sure maybe 90k? was HP 0 but showing as In Duty in the party list for about 5-10 mins. During those 5-10 mins two vote dismiss attempts failed to go through.
