Arm-chair lawyers on twitter/discord/where ever that think they know the legality of that billboard have no idea how actual copyright law works and probably haven't even taken a moment to look at SE's own actual Creative Commons License.

The people who made the billboard could be suspended or banned from the game, however, because they have obviously infringed on the TOS for misrepresenting the game with an SE trademark. But.. being sued? Get a grip, lmao.

The advertisements in cities/hub areas have definitely gotten considerably worse over the past few months. I'd say it's really only peaked to such a level as being literal spam since Endwalker came out. I started in 2.0 and in the entirety of this game's lifespan, at least on the server I'm on, I have never seen people spamming ads for RP venues/clubs in shout chat until now. A couple years ago, they would have probably been ridiculed for it if they tried it, honestly, if not reported for spamming outright. The nature of the ad doesn't make it not spam, there's functionally no difference in RP venue/club spam than there were those annoying gilseller ones. It's still annoying to see chat filled with a two-part paragraph of text from multiple users back-to-back ad nauseum any time you try to go to a city. On my server, I actually kept track of the timestamps and there were approx. 4 two-part ads every 10 minutes in Limsa. Which is enough that you essentially ALWAYS have one of those ads visible in your chat.

The "blacklist" thing doesn't help, because these are random people from other servers most of the time that seem to only be around on certain days, and it will be someone different the next day if not the same day. The "don't use shout chat" argument is honestly moronic because why should anyone have to disable an entire function of the game to counteract people that are being inconsiderate of others? Shout chat is frequently used by people asking for help with something and they get drowned out by the ads. The RP venues appeal to what I'd estimate as less than ~5% of the total population of the game, but the footprint of the ads is so massive that it effects everyone, including the people unfamiliar with RP as a whole with no interest in it.

They're so widespread that I've seen them spammed in nearly every single city at various times as well. Limsa, Gridania, and Ul'dah are obvious, but I have seen them in Foundation/The Pillars, Kugane, Rhalgr's Reach, Idyllshire, Sharlayan, and Radz-at-Han on a regular basis. Anywhere that players may be present they end up appearing eventually.

tl;dr: RP venue ads are the same as FC ad spam or gilseller spam. It's all spam. It's all annoying. Keep it out of shout chat and in the "Other" section of PF instead.

People have become too comfortable being 'lewd' in public, honestly. ERP and erotic venues have always existed, and didn't bother anyone but those who are wound way too tightly.

Problem now is we got people out here with the confidence to talk about their petplay on the OF. C'mon, people please don't ruin the good thing we have by forcing SE's hand. Respect others and be mindful of your interactions with strangers.

The owner of the Billboard, the company, provides a commercial service that is paid for, that could potentially get them sued by SE even though thats increadibly unlikely. (and even more unlikely that the billboard company doesn't have a protection waiver stating that all libel, fraud, etc. is the responsibility of the person putting up the ad) That billboard company could then sue the persons who ordered the billboard, and or the billboard company could also potentially sue for libel if the add ends up damaging their reputation as being a company that breaks copyright laws.
SE could also sue the persons who ordered the billboard for breaking the above, as it would be their responsibility to be in compliance, and not the billboard companies. That is to say: The commercial use violation would be solely the use of the advertisement on the billboard, as the billboard would qualify as commercial use. Thats why, if you noticed, they made sure to include the trademark notices.
Now, I don't live in California so I don't know the laws that specifically govern the protection of advertisers and things like billboards.
But clearly, neither do you. So instead of ignoring the fact that a 3rd party was used to advertise an event under the licenses of SE, maybe don't act like your not arm-chair lawyering yourself.
And with that, I'm gunna go ahead and agree with you that its increadibly unlikely that it could occur.
