From the example you posted, it looks like the person needs to have it cleared but from his description it looks like he only wants people who has cleared it before (and he is super rude about it). ...

According to the patch notes it stats:

"The Duty Finder has been adjusted so that players who have been vote-dismissed are not immediately available as candidates for rejoining the same party."

What they should have done is make it so that you can't rejoin the same party again instead. There are many reasons for getting kick, sometimes it might not even be your fault.
